The U.S. Supreme Court tackled a case on Tuesday involving a New York state man who was fired from his job as a commercial truck driver for failing a drug test after taking cannabidiol, or CBD, that he said was falsely sold as lacking the psychoactive ingredient present in marijuana.

A truck driver is trying to use an anti-racketeering law to recover lost wages after unknowingly ingested a product he said contained THC.

The driver, Douglas Horn, sued the maker of a product said to be free of THC under a federal racketeering law, saying he had suffered a business injury.

The Supreme Court will hear a case involving a mislabeled medical marijuana product. A commercial truck driver suffering from hip and shoulder injuries took the product which claimed to have zero THC,
